Welcome to Kirra Creative Agency (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern the use of our services, website (www.kirracreativeagency.com), and all agreements made with our clients (“you,” “your”). By engaging our services, you agree to these Terms.

1. Services Provided

We offer branding, website design, user-generated content (UGC), email marketing, and business support services. Scope, deliverables, and timelines will be outlined in a separate project agreement or invoice.

2. Payments & Deposits

  • A non-refundable deposit is required to secure your project. Work will not commence until payment is received.

  • Full payment is required before final files, website access, or live deployment.

  • Late payments may incur a 5% weekly late fee.

  • If a payment plan is agreed upon, failure to make payments on time may result in project suspension.

3. No Refund Policy

  • Deposits are strictly non-refundable, as they secure our time and resources.

  • Refunds will not be provided for change of mind, delays caused by the client, or dissatisfaction if work aligns with the agreed project scope.

  • If a project is cancelled by you before completion, all payments made up to that point are forfeited.

4. Project Timelines & Client Responsibilities

  • Estimated timelines are provided at project commencement. These may be extended due to delays in client feedback, approvals, or unforeseen circumstances.

  • You must provide all required content (e.g., branding details, images, copy) on time. Delays in submission will push back deadlines.

  • If a project is inactive for 30 days due to lack of response, it may be archived. A restart fee may apply.

5. Revisions & Scope Creep

  • Project includes 3 rounds of revisions. Additional changes will incur extra charges.

  • Any requests beyond the agreed scope will be considered out-of-scope and quoted separately.

6. Intellectual Property & Ownership

  • We retain copyright ownership of all original design files, concepts, and drafts unless otherwise agreed upon.

  • Upon full payment, you receive the rights to final, approved designs for use in your business.

  • We reserve the right to showcase completed work in our portfolio and promotional materials.

7. Website Design & Development

  • Website designs will be built on the agreed platform (e.g., Shopify, WordPress, Squarespace).

  • Once handed over, you are responsible for ongoing website maintenance, security, and updates unless you engage us for support services.

  • If hosting or domain services are provided by a third party, we are not responsible for any outages or issues beyond our control.

8. User-Generated Content (UGC) & Photography

  • Content created by our team or selected creators is provided with a limited-use license for your business.

  • You may not resell, redistribute, or alter content without permission.

9. Limitation of Liability

  • We are not liable for any loss of revenue, business interruptions, or third-party service failures related to our work.

  • Once a website or branding asset is handed over, you assume full responsibility for its use.

  • We do not guarantee specific marketing or sales results from our designs or services.

10. Termination of Services

  • We reserve the right to cancel a project if a client is unresponsive, fails to make payments, or engages in disrespectful or inappropriate conduct.

  • If a project is terminated due to breach of terms, all work completed up to that point remains our property, and payments made are non-refundable.

11. Amendments & Updates

We may update these Terms at any time. Continued use of our services implies acceptance of any changes.
